Notification to the shareholders and interested parties
Subject: "Submission of Restraining Order by EMO (Energy Market Operator – LAGIE)"
As a further development to “Note 24” reported in the financial statements for the year 2014, on the submission of a restraining order by EMO against IPTO totaling € 300 million with seizure of all assets, and the litigations of a total amount € 500 million (principal and interest resulting from overdue invoices which remain unpaid or delayed payments by IPTO)
WE NOTIFY:
(a) EMO has resigned from the Restraining Order,
(b) The bulk of overdue payables to EMO have been settled by IPTO with subsequent payments, after the collection of overdue receivables by IPTO from Electricity Market Participants. The outstanding amount of the litigation is € 55.4 million.
Under the regulatory framework, the company operates as an intermediary in the Energy Market, where inter alia the tasks, is the Energy settlement meaning the collection of funds from energy suppliers and payment of energy producers and EMO. In this framework the company, based also on a relevant decision by RAE, is acting as an agent, is not the debtor of relevant amounts and is not paying the pertinent outstanding debts to energy producers and EMO owed by their debtors (energy suppliers).
